1. Acceptance of Terms

By accessing or using the Maxim Disposal website (maximdisposal.com) or any of our services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services. These terms apply to all visitors, customers, and others who access or use our services.

2. Services

Maxim Disposal provides roll-off dumpster rental, yard waste disposal, equipment hauling, and related waste removal services in Fort Myers, Florida and surrounding Southwest Florida communities. Our services are available to both residential and commercial customers. Service availability, pricing, and scheduling are subject to change without notice.

3. Rental Agreement

When you rent a dumpster or engage any service from Maxim Disposal, the following conditions apply:

  • Rental periods and pricing are agreed upon at the time of booking. Extension fees may apply if the rental period is exceeded.
  • You are responsible for the dumpster while it is on your property and must ensure it is placed in a safe, accessible location.
  • Prohibited items include, but are not limited to: hazardous materials, chemicals, flammable liquids, asbestos, batteries, paint, and electronics. Disposal of prohibited items may result in additional fees and legal liability.
  • If you have a need to dispose of any of the above prohibited items, please contact us to discuss your specific situation. We handle special circumstances on a case-by-case basis and may be able to accommodate your needs.
  • Tires and mattresses are accepted but are billed per item in addition to the standard rental rate. Pricing varies based on item type and quantity; our team will provide applicable rates at the time of booking.
  • Overfilled dumpsters (materials above the container rim) will not be picked up until excess material is removed. Additional fees may apply.
  • Any damage to the dumpster beyond normal wear and tear caused during your rental period is your responsibility.
  • You are responsible for obtaining any required permits for dumpster placement in public rights-of-way.

4. Quotes and Payments

Quotes provided by Maxim Disposal are estimates based on information provided at the time of inquiry. Final pricing may vary based on the actual weight, type of materials, and rental duration. Payment terms will be communicated at the time of booking. Late payments may be subject to additional charges.

All invoices must be paid in full by the due date specified at the time of service. Timely payment is not optional and is a material condition of these Terms and Conditions. Failure to pay in a timely manner may result in late fees, suspension of future services, referral of the account to collections, and/or legal action to recover amounts owed, including reasonable attorneys’ fees and collection costs. Maxim Disposal reserves the right to refuse future service to any customer with an outstanding balance.

5. Scheduling and Cancellations

Maxim Disposal will make reasonable efforts to fulfill delivery and pickup requests at the agreed-upon times. Delivery times may be affected by weather, road conditions, equipment availability, and other factors outside our control. Cancellations must be made before delivery; cancellations after delivery has occurred or is in progress may result in additional fees. We reserve the right to cancel or reschedule services due to unsafe conditions or other circumstances.

6. Limitation of Liability

To the fullest extent permitted by law, Maxim Disposal shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability for any claim related to our services shall not exceed the amount paid for those services. We are not responsible for damage to driveways, pavement, or landscaping resulting from the normal delivery and pickup of dumpsters.

7. Indemnification

You agree to indemnify, defend, and hold harmless Maxim Disposal, its owners, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of our services, violation of these Terms, or violation of any applicable law or regulation.

8. Prohibited Uses

You agree not to use our website or services to:

  • Violate any applicable local, state, or federal laws or regulations.
  • Dispose of hazardous, toxic, or illegal materials.
  • Misrepresent the type or quantity of materials to be disposed of.
  • Engage in any activity that could harm Maxim Disposal, its employees, or other customers.

9. Intellectual Property

All content on the Maxim Disposal website, including text, images, logos, and graphics, is the property of Maxim Disposal and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use any content without our prior written permission.

10. Changes to Terms

Maxim Disposal reserves the right to update or modify these Terms and Conditions at any time. Changes will be effective upon posting to the website. Your continued use of our website or services following any changes constitutes acceptance of the revised terms.

11. Governing Law

These Terms and Conditions are governed by the laws of the State of Florida. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts located in Lee County, Florida.
